Teenager Files Claim Against the City of Costa Mesa After Traffic Accident

An 18-year-old San Clemente resident has filed a $42,000 claim against the city of Costa Mesa following a traffic accident at Fairview Road and Fair Drive that occurred on November 18, 2009, the Los Angeles Times reports.

In her claim, Katelyn Obbards states that she was riding her bicycle eastbound on Fair Drive at the Fairview Road intersection, and, as she crossed the intersection through a green light, the traffic signal changed from yellow to red in a few quick seconds, causing her to be hit from behind by a car traveling northbound on Fairview who accelerated when the signal opposing Obbards turned green.

As a result of the incident, Obbards suffered injuries including the loss of several teeth, facial lacerations, a fractured back, and a herniated disc.  According to Obbard’s attorney, a police officer that arrived at the scene of the accident had commented that the timing on the traffic signals was off.

It is the city’s responsibility to ensure that traffic signals function properly. If the signal was in fact off on the night of Obbard’s accident, the city of Costa Mesa may be held liable for her injuries and damages, including medical treatment, lost wages, and pain suffering.

Doctor Brings Suit Against Allergen Following Botox Injections

An Oklahoma doctor has filed the second recent lawsuit against Botox manufacturer Allergen, the Orange County Register reports.  Dr. Sharla Helton, 47, alleges that the Botox injections she received in 2006 to alleviate wrinkles caused physical symptoms that included weakness, shortness of breath, double vision, and arm, hand, and foot pain.

Allergen denies that Botox injections caused Dr. Helton’s symptoms.

There are at least five other plaintiffs who have filed suits against Allergen, according to the article.  Helton’s attorney, Ray Chester, recently tried another case against Allergen regarding Botox injections and lost.  In that case, a young girl stricken with cerebral palsy was administered Botox injections to relax her limbs.  Allergen paid for the girl’s physician (and many other doctors nationwide) to be trained to inject an amount of Botox in patients that was equivalent to an overdose. The girl later died of respiratory failure, which Allergen’s attorney successfully argued could not be conclusively linked to the Botox injections as the cause of her death.

Court documents reveal that in 2005, a year before the girl began Botox treatments, Allergen reported 38 patients who had suffered seizures following Botox injections to the Federal Drug Administration, including nearly 20 children with cerebral palsy.

As Helton’s trial gets underway in the next month, Chester will seek again to prove Allergen’s negligence in disclosing the risks of using Botox.

Bicyclist Injured in San Diego Crash

A 24-year-old San Diego woman was seriously injured on Saturday in a bicycle to car collision on Genesee Avenue at La Jolla Village Drive, the San Diego Tribune reports.

The woman, whose name has not yet been released, was riding her bicycle northbound on Genesee when she was struck by a sedan traveling westbound on La Jolla Village Drive.  The cause of the accident is still under investigation, although police have determined that alcohol was not a contributing factor.

Many details of this accident remain unclear. Which person had the right of way? Was distracted driving (eating, texting, talking on a cell phone while driving) a factor?  Did dangerous road conditions cause either the biker or driver to swerve?  By answering these questions, we may begin to see a clearer picture of who was at fault in this situation.

DUI Hit and Run Kills San Diego Man

27-year-old Oscar Lopez was killed Sunday night after being hit by a drunken driver on the Interstate 5, the San Diego Tribune reports.  Lopez was sleeping in the back seat of while his wife, Angela Lopez, drove their 2004 Ford Explorer, when 43 year old William Romero struck the Lopez’ car after drifting into their lane.

Oscar Lopez was ejected from the vehicle and pronounced dead at the scene. The Lopez’ son, Oscar Jr., was also ejected from the back seat of the vehicle but sustained only minor injuries.  Angela Lopez and a front seat passenger Ashley Lopez, Oscar’s sister, were uninjured.

Romero, who was driving while intoxicated, fled the scene of the accident and was later caught by authorities and arrested.  He is being held on bail with felony charges of drunken driving and vehicular manslaughter.

Stuntwoman Killed in LA Motorcycle Crash

April Erin Stirton, a 28-year-old stuntwoman from North Hollywood, was killed on Tuesday in a motorcycle crash on the 101 Freeway near Laurel Canyon Boulevard.  According to the Los Angeles Times, Stirton attempted to pass a tow truck ahead of her in the same lane when she lost control of her motorcycle and fell, hitting the back wheels of the truck she was attempting to pass.  Stirton’s motorcycle then crossed two lanes and became stuck underneath the wheels of another truck.

According to a recent Los Angeles Times article (http://www.latimes.com/news/local/la-me-motorcycle-safety18-2009oct18,0,6000706.story), there are about 100,000 motorcycle crashes annually in the United States.  In 2008, 5,290 of these crashes resulted in death.  In 2007, there were 85 fatalities resulting from motorcycle crashes in Los Angeles County alone, according to the Statewide Integrated Traffic Records System.

Thirteen Year old Pedestrian Struck and Killed By Car on the PCH

Los Angeles County Sheriff’s officials are continuing to search for witnesses to a fatal car to pedestrian accident on the Pacific Coast Highway on Saturday.  According to an article in the Los Angeles Times, 13-year-old Emily Rose Shane was walking northbound on the right side of the Pacific Coast Highway near Kanan Dume Road when she was struck and killed by a car driven by Sina Khankhanian, 26.

Authorities believe Khankhanian may have purposefully crashed his vehicle, although he did not intend to strike the victim. Anyone who witnessed the accident or has information may call the investigating Sheriff’s Department at (323) 890-5500.

This article does not give many details on how the accident occurred.  Many questions arise from the lack of information, such as whether the driver was distracted, under the influence of alcohol or drugs, or facing road conditions that may have caused him to swerve suddenly.  As the Sheriff’s Department continues their investigation, some of these details may come to light and help piece together why this terrible accident occurred.

Apellate Panel Overturns Ruling in Fatal Los Angeles Car Accident

An appellate panel from the 2nd District Court of Appeal overturned a ruling by a Los Angeles Superior Court judge regarding second degree murder charges in a 2009 big rig to car accident on Tuesday, the Los Angeles Times reports.

Marcos Barbosa Costa, 44, of Everett, Massachusetts, drove a big rig on the Angeles Crest Highway into La Cañada Flintridge on April 1, 2009 despite the fact that his brakes were not working properly.  Costa passed two truck turnouts, where he could have safely stopped his truck, before his brakes eventually gave out and his truck struck a compact car, instantly killing its driver and passenger.

Los Angeles Superior Court Judge Lisa Lench dismissed second-degree murder counts against Costa in October, however the prosecution appealed her ruling and the three justice appellate panel found there was sufficient evidence that Costa was aware of the condition of his brakes and continued to operate his vehicle despite the risk it presented to himself and others.

Ventura Teen Struck by Car

17-year-old Candice Fulcher was struck and critically injured by a vehicle while running across an intersection to catch a school bus on Thursday, the Ventura County Star reports.

According to witnesses, Fulcher, of Ventura, was crossing north Telephone Road in a crosswalk against a red light when a car driven by 24-year-old Monique Rodriguez, also of Ventura, struck her.  Rodriguez was not cited for the crash and was fully cooperative with authorities.  Fulcher is currently being treated at Santa Barbara Cottage Hospital.

One witness to the incident noted that he often sees students crossing the same intersection against a red light in order to catch the school bus on Petit Avenue, highlighting an area in which school district and city officials may need to improve student safety and facilitate discussion on student bus stops.

Amtrak Train Collides with Pick Up Truck in Moorpark

36-year-old Joseph Tillery was killed Monday morning when the pick up truck he was driving collided with a westbound Amtrak train on Highway 118 near Hitch Boulevard at the Peach Hill Soils crossing, the Ventura County Star reports.

Tillery’s car was pushed a quarter mile down the tracks after being broadsided by the Amtrak surfliner train, which was carrying 125 passengers at the time of the crash.  There were no injuries reported onboard the train.

The Peach Tree Soils crossing, which is a private railroad crossing with no signals or railroad gates, had already been scheduled to receive public funding to improve the crossing’s safety –including installing devices to warn drivers who cross the tracks of oncoming trains.   According to the Ventura County Transportation Commission, two other private railroad crossings have already been improved thanks to public funding in the past five years.

This is a terrible tragedy and I offer my deepest sympathies to Mr. Tillery’s loved ones in this time of loss.

Woman Injured on Huntington Beach Sidewalk Files Claim for $100,000

A seventy-one year old Huntington Beach resident has filed a claim against the city of Huntington Beach following a sidewalk fall, the Orange County Register reports.

Sharon R. Peterson fractured her femur when she fell while walking on Modal Drive on October 7, 2009, the claim states.  An uneven portion of sidewalk caused Peterson’s fall.  She claims the city was negligent in its maintenance and proper care for the sidewalk.
